  The three parts of this book are written by two scholars. Apart from the selected translations from Xingan huilan, which forms the second part, part I was writtenby ProfessorBodde and is entitled "PreliminaryEssay on Concepts And Practices", which is an general introduction to the legal concepts and principles in China; Part Three summarizes the function of law in Chinese society and assesses the application of the Ch'ing laws and the principles involved, in the light of the particular cases that are presented. Though this is an introduction to law in China aimed for foreign students, I find it equally helpful for me, a student outside the field of Chinese law, in particular the first part.

  Chapter 1 provides quite precise a introduction of the most basic information about China law. The major topics include: 1) the interaction between li and fa, that is the Confucianization of fa and legislation of li. This conflict originates from the conflict between Confucianism and Legalism, and finds its expression in the legal system throughout history. 2) the secular origin of Chinese law; 3) the emphasis on penal law and negligence of civil law; 4) the priority of preserving the Confucian status differences; 5) lack of concern about individual rights, etc.

  After this general introduction, the following three chapters enter into more technical aspects of the Qing legal system in three categories: legal codes, penal system and judiciary. This part is also well structured and concise. For example, chapter 2 introduces the structure of Qing code which develops from the previous codes. It includes men, xiang, lu(statute) and li(substatute) as well as annotation and interpretation. Chapter 3 starts with the five basic punishments and then go through all the major types of punishments, and ends with some Western witnesses’ recording of Chinese legal punishment. Chapter 4 goes through the judiciary system, the ways to appeal, the Board of Punishment, and the capital cases.

  After this overview, the authors provide a translation of selected 190 cases respectively from ministries of 工刑兵禮戶吏. Then, there is a long discussion of the legal practices based on the codes, that is, how legal codes are interpreted and exercised in legal practices. In this way the authors try to depict a clearer picture of Chinese law and society.

  The most important achievement of this book is that it keeps a good balance and combination in laying out the major principles as well as historical development. For example, it introduces the basic conflict between li and fa, and then traces its development through history. In introducing an element, it always gives its historical sources, like the important legal code genre li (sub-statute) which appears from Ming. It also introduces the study of Chinese law by the time of its writing, the 1960s.

  A pioneering work, it is of course open to questions. Some reviewer points out, for example, named Law in Imperial Chian, it actually focuses on the Qing Dynasty, assuming a static continuity. But “as a matter of fact, one well-known Chinese author declares that there is a considerable difference between the T'ang and the Ming code-on which the Ch'ing code is mainly based, the Ming code having undergone the influence of the law in Mongol times.” Indeed, the development of Chinese legal history, along the line of the development of Chinese culture in general, should be a rich field, and can be combined with studies in many other areas. Scholars’ recent interest in the development of sex law and the regulation of female chastity can be seen as one of such studies.

  Another direction of potential interest is the interaction between li and fa. In particular, from the Ming dynasty, laws were divided into seven men: 工刑兵禮戶吏. Under “禮律” one fines “祭祀”和“儀制”. Isn’t this exactly what people have been concerned about when they study Ritual in China? From Confucian classic to daily practices, li permeates in every corner of Chinese culture and society. The Legalization and legislation of li might be a way to bridge the gap between intellectual history and social history.
